  • The City of Deadwood believes that the regulation of medical cannabis is necessary for the health and safety of our community. Except where permitted by statute, South Dakota state law and Deadwood city ordinances expressly prohibit:

    · The public consumption of cannabis products (this includes consuming or smoking cannabis on the premises of Trail’s Head Co. facilities and adjacent trailhead and parking lots)

    · Driving or operating a motorized vehicle of any type (including a train, aircraft, boat, watercraft, and automobile) or riding a bicycle while under the influence of marijuana

    · The consumption and use of marijuana products by individuals under 21 years-old, unless under medical advisement and adult supervision

    · The consumption and use of marijuana products when not under medical supervision based on a state-certified medical cannabis card

  • · Yes! South Dakota’s new card-based medical cannabis law is effective July 1, 2022. Trail’s Head Co. will began selling medical cannabis products to card-holding patients and care providers in November of 2022.

  • State-certified physicians, physician's assistants, and nurse practitioners are eligible to certify patients as qualifying for medical cannabis use.

  • In any consecutive fourteen-day period, resident and non-resident medical cannabis cardholders can legally purchase, possess, transport, and provide as a caregiver for another up to three ounces of medical cannabis flower in South Dakota, and/or such other restrictions set by the South Dakota Department of Health. To ensure compliance with these regulations, Trail’s Head Co. keeps accurate records of all cannabis sales.

  • · On two separate South Dakota 2020 ballot measures sponsored by New Approach South Dakota and South Dakotans for Better Marijuana Laws (SDBML), citizens of the Mount Rushmore state overwhelming voted for the legalization of both medical and recreational marijuana.

    · While the legislature passed reform for medical marijuana laws effective July 1, 2022, Constitutional Amendment A, a recreational marijuana initiative, was overturned based on a lawsuit filed on behalf of Governor Kristi Noem. The circuit court in February 2021 ruled that the initiative violated the state's single-subject rule, which then constituted a revision of the constitution rather than an amendment.

    · In October 2021, SDBML began circulating again among registered South Dakota voters a petition to restore the recreational marijuana law unjustly taken from South Dakota citizens at tax-payer expenses. The voter circulated petition submitted on May 3, 2022 by SDBML would place an adult-use cannabis legalization initiated measure on the November 2022 ballot. The measure will be an amendment to SDCL [34-20G] https://sdlegislature.gov/Statutes/Codified_Laws/2078844

    · As this piece-meal progress toward South Dakota marijuana reform continues, Trail’s Head Co. is excited about what the future of cannabis holds for South Dakota, the Black Hills region, the City of Deadwood, as well as for our cherished non-resident visitors.     · Because of newly-passed legislation for a slowly-evolving industry within our state (updates here), our medicinal cannabis products will not be available until July 1, 2022. At that time, Trail’s Head Co. will begin accepting both South Dakota medical cannabis cards, as well as state-certified non-resident medical marijuana cards.

  • · As of July 1, 2022, both resident and non-resident medical cannabis cardholders can legally purchase, possess, transport and provide as a caregiver for another up to three ounces of medical cannabis flower, and/or such other restrictions set by the South Dakota Department of Health.

    · Any verified certified medical cannabis cardholder over the age of 21 may grow four cannabis plants in their private residence at one time. Only two of those plants can be in the state of growth at which they produce flowering buds, while the other two plants cannot be beyond the vegetative growth stage.

  • Patients under the age of 18 can be registered with the state for medical cannabis use only if the qualifying patient's practitioner explains in detail the possible risks and benefits of the substance to the custodial parent or legal guardian with responsibility for the patient’s healthcare decisions. The said parent or guardian then consents in writing to:

    · Allow the use by the child

    · Be the child's designated caregiver
    · Control the acquisition, dosage, and frequency of use by the child
